What is mediation and how can it help me?

Mediation helps those in dispute communicate about the issues of concern to them, and helps participants find solutions that are acceptable to everybody involved.

Mediation is when an independent, impartial third party discusses a problem between you and your employer (or between you and another employee) and tries to find a solution. Often used when informal discussions fail to reach a resolution.

Arbitration is voluntary and the arbitrator cannot compel you or your employer to accept any resolution. You and your employer should agree on how to resolve the dispute.

How does mediation work?

Parties in dispute try to negotiate an agreeable settlement with the help of an impartial third person, who mediates between them. The mediator assists the parties through a discussion process with the objective of helping them find that settlement at the end.

Conciliation

Conciliation is similar to mediation but is normally used when:

  • you believe you may be entitled to make a claim to an employment tribunal
  • you have already made a claim to an employment tribunal

Conciliation is voluntary – both you and your employer must agree to it before it happens.

Arbitration

Arbitration is when a third-party makes a firm decision on a case after considering all the issues.

You and your employer must agree to an arbitrator’s decision being legally binding. If you do not agree, you can still take a case to an employment tribunal.
